Terms of Service
These terms govern your access to and use of Bonpopup (the “Service”), a hosted tool for building popups and embedding them on websites you control. By creating an account or installing the embed script, you agree to these terms.
1. Your account
You need an account to save popups. You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity that happens under your account. Tell us promptly if you believe your account has been accessed without your permission.
We may suspend or close an account that is used in breach of these terms, or where required by law.
2. Acceptable use
You agree not to use the Service to:
- Publish content that is unlawful, deceptive, or infringes someone else's rights.
- Impersonate another business or misrepresent your affiliation with one.
- Collect personal data from visitors without a lawful basis and appropriate notice.
- Deploy popups designed to trap, mislead, or obstruct visitors from leaving a page.
- Interfere with the Service, probe it for vulnerabilities without authorisation, or attempt to circumvent plan limits.
- Embed a popup on a website you do not own or have permission to modify.
3. Your content
You keep ownership of the text, images, and other material you add to your popups. You grant us the limited licence needed to host that material and to serve it to visitors of the sites where you install your popups.
You are responsible for having the rights to everything you upload, and for making sure your popups comply with the laws that apply to your audience — including consent, privacy, and advertising rules.
4. Plans and payment
The Basic plan is free. Paid plans are billed in advance on a recurring basis and renew automatically until cancelled. Fees are stated exclusive of taxes unless noted otherwise.
You can cancel at any time; cancellation takes effect at the end of the current billing period. If you downgrade, popups you have already published continue to run, but plan-restricted fields become read-only.
5. Service availability
We work to keep the Service and the embed engine available, but we do not promise uninterrupted operation. We may change, suspend, or discontinue features, and will give reasonable notice of material changes that reduce functionality you rely on.
6. Third-party websites
The embed script runs on websites you control. You are responsible for how it interacts with your own site, your other scripts, and your visitors' experience. We are not responsible for the content or behaviour of the sites where popups are installed.
7. Disclaimers
The Service is provided “as is”. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that using the Service will produce any particular conversion rate or business result.
8. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of the Service is limited to the amount you paid us in the twelve months before the claim arose.
9. Termination
You may stop using the Service at any time by deleting your account. On termination your right to use the Service ends, your popups stop being served, and we may delete your stored content after a reasonable period.
10. Changes to these terms
We may update these terms as the Service develops. If a change is material, we will give notice before it takes effect. Continuing to use the Service after that point means you accept the updated terms.
